Terms of Use

 

These Terms of Use describe the conditions under which the mobile application and/or web application of "Route2school" from the Transportation Research Institute (IMOB) at Hasselt University and ABEONAconsult bvba (a spin-off of IMOB) may be used. By consulting the mobile application and web application of 'Route2school', the User accepts the following terms and conditions without reservation. Anyone who does not agree with the content of these Terms of Use is expressly requested to refrain from consulting the Route2school mobile application and web application. 1. Definitions

     

      • IMOB: the Transportation Research Institute at Hasselt University

      • ABEONA: ABEONAconsult LLC (spin-off of IMOB)

      • User: the natural or legal person who wishes to use the Route2school mobile application and/or web application and who has accepted the Route2school Terms of Use by registering and agreeing to them.

      • Terms of use: the set of conditions under which the user may use the Route2school mobile application and web application and to which he explicitly agrees by registering and accepting the terms and conditions.

    2. License

    ABEONA grants the User a non-exclusive, non-sublicensable, and non-transferable license to use the Route2school mobile application and/or web application.

    ABEONA reserves the right at all times to modify, change, or remove Route2school and its functionalities, as well as to make updates and upgrades available and/or implement them at its own discretion. ABEONA and/or IMOB may also unilaterally terminate the license, restrict the use of the license, or deny access to the mobile application and/or web application of "Route2school" in whole or in part, temporarily or permanently. ABEONA & IMOB are not obliged to inform the User of this. ABEONA & IMOB have no obligation to comply or any obligation to pay compensation in such cases. Any liability of IMOB and/or ABEONA in this regard is excluded. ABEONA and/or IMOB have the right to modify the functionalities offered from time to time in order to improve or change them and to correct errors. IMOB & ABEONA will endeavor to resolve any errors in the Route2school software but cannot guarantee that all errors will be corrected, whether in a timely manner or otherwise.

    3. Use

    This license grants the User permission to:

       

        1. Download, install, and use the Route2school mobile application and web application for personal purposes on all compatible devices owned or managed by the user.

        1. Use updates that ABEONA and/or IMOB will provide at regular intervals.

      By agreeing to these Terms of Use, the User is also bound by certain conditions. The User shall:

         

          1. Do not make copies of the Route2school mobile application and/or web application.

          1. Do not rent, lease, lend, sell, or distribute the Route2school mobile application and/or web application.

          1. Do not make any modifications to the Route2school mobile application and/or web application, do not create any derivative products based on all or part of Route2school, and do not combine or incorporate all or part of Route2school into any other service or product.

          1. Not making the Route2school mobile application and/or web application available, in whole or in part, in any form whatsoever to persons for commercial purposes.

          1. Do not use the Route2school mobile application and/or web application for illegal activities, such as infringing or violating the rights of another party.

          1. Do not use the Route2school mobile application and/or web application in any unauthorized manner whatsoever. If the User violates one or more of these conditions, ABEONA and/or IMOB will take legal action against the User.

        4. Liability and warranties

        ABEONA, IMOB, and the responsible government agency cannot be held liable for the content of photos, descriptions, solutions, advice, and routes provided by Users. ABEONA, IMOB, and the responsible government agency accept no liability whatsoever for any damage that may arise from any use of the information on the Route2school mobile application and/or web application.

        ABEONA, IMOB, and the responsible government agency cannot guarantee the accuracy and completeness of the information on the Route2school mobile application and web application and therefore cannot be held liable, on any grounds whatsoever, for any error on the Route2school mobile application and web application. ABEONA, IMOB, and its partners cannot be held liable for any direct or indirect damage suffered by anyone as a result of consulting information published on the Route2school mobile application or web application.

        ABEONA is committed to ensuring maximum and constant availability of the website. However, ABEONA cannot be held liable in the event of technical errors or interruptions to the Route2school mobile application or web application, regardless of the duration of the disruption. ABEONA and/or IMOB cannot be held liable for any loss of data.

        5. Termination of use of the Route2school mobile application and/or Route2school software by the user

        The User may terminate the use of the Route2school mobile application and/or web application at any time by removing or uninstalling the software from their devices.

        6. Privacy and Cookies

        Route2School may process personal data by providing the Services or via the Website. For more information about Route2School's privacy and cookie policy, please see our Privacy andCookieStatement.

        7. Applicable law, dispute resolution

        These Terms of Use are governed exclusively by Belgian law. Any disputes arising from these Terms of Use shall be submitted to the courts of Hasselt, which shall have exclusive jurisdiction. ABEONA and/or IMOB may only be sued before the courts of Hasselt.
